Distance Subscription Agreement

This is an English translation, provided for information. The binding version is the Turkish one, and the Turkish text prevails in the event of any difference. This agreement is formed electronically between Packdroid and subscribers who are consumers, under Law No. 6502 and the Distance Contracts Regulation. Consumer legislation does not apply to subscribers acting as traders or tradespeople. The Pre-Sale Information Form and the Terms of Use are integral parts of this agreement; in case of conflict, mandatory provisions and this agreement take precedence for consumers.
1. Parties

- Buyer: the user whose details are taken electronically at purchase (“Subscriber”).
2. Subject
The subject of this agreement is Packdroid supplying, as a digital service, browser-based access to its dieline generation software and the export rights of the chosen subscription plan, and the Subscriber paying for it.
3. Scope and nature of the service
The subscription covers access to the catalogue, 2D/3D preview, and the export rights of the chosen plan (SVG, PDF, DXF; without the Packdroid mark).
Every output is a starting draft; proofing a sample before series production is the Subscriber's obligation (Terms of Use §§2–3 and 10–11 apply to this agreement as well; consumers' rights under mandatory provisions are reserved).
4. Price and payment
Subscription prices are given below in US dollars. Subscribers resident in Türkiye are additionally shown the Turkish Lira equivalent, inclusive of taxes, on the purchase page and at checkout; the binding amount is the one displayed at checkout.
Payment is taken through Paddle.com Market Ltd.; card details are never seen or stored by Packdroid.
The subscription renews automatically at the end of each period and is charged to the same payment method. Price increases are notified by email at least 15 days before they take effect; a Subscriber who does not accept may end the agreement at the end of the period.
If collection fails, access drops to free usage; no debt accrues.

5. Performance and right of withdrawal
Performance begins immediately on confirmation of payment. At the purchase step the Subscriber has separately and expressly confirmed that they request immediate performance and that they will therefore lose their right of withdrawal under Article 15/1-(ğ) of the Distance Contracts Regulation. No subscription is started without that confirmation.
6. Term, cancellation and termination
The agreement continues by renewing in monthly or yearly periods according to the plan chosen.
The Subscriber may cancel in one step from account settings before the renewal date; cancellation takes effect at the end of the period.
Even where there is no statutory right of withdrawal, and so no obligation to refund, we give a contractual 30-day money-back guarantee on every payment under our Refund & Cancellation Policy. That guarantee is offered in addition to the Subscriber's legal rights, not instead of them.
Packdroid may terminate the agreement on serious or repeated breach of the Terms of Use. In that case the price for the remaining period is assessed within mandatory provisions, having regard to the nature of the breach.
The Subscriber is informed of changes that materially narrow a paid plan; a Subscriber who does not accept may terminate and request a refund for the remaining period.
7. Defective performance
Where the service is performed contrary to the agreement (defectively), the Subscriber may exercise the rights to have performance repeated, to a price reduction, or to withdraw from the agreement, within the provisions of Law No. 6502 on defective services. Notices go to [email protected].
The “parametric starting draft” character of the service, as described in the Pre-Sale Information Form and the Terms of Use, is the agreed performance itself and is not a defect. Loss arising because the Subscriber went to production without proofing a physical sample stems from breach of the verification obligation, not from a defect in the service. Consumers' rights under mandatory provisions are reserved.
8. Personal data
Details of personal data processing are in the Privacy Policy and the KVKK Disclosure Notice, both reachable from the purchase page.
9. Evidence and retention
Electronic records of the agreement's formation (confirmation date and time, IP address, text version) are retained by Packdroid, and this agreement together with the Pre-Sale Information Form is sent to the Subscriber's email address on a durable medium once formed. These electronic records constitute evidence in disputes between the parties; the Subscriber's right to prove by any means is reserved.
10. Governing law and jurisdiction
This agreement is governed by the law of the Republic of Türkiye. Consumer Arbitration Committees at the Subscriber's place of residence or the place of the transaction have jurisdiction within the monetary limits announced by the Ministry of Trade, and Consumer Courts above those limits.
11. Entry into force
The agreement is formed and enters into force when the Subscriber confirms it electronically at the purchase step.
